The Clerk of the Circuit Court acts as an agent for the State of Florida for issuing marriage licenses as outlined in chapter 741, Florida Statutes.

The Martin County Clerk’s Office issues marriage licenses to all qualifying couples. This service is available in the main courthouse and branch offices during regular posted hours.

Steps to Obtain a Marriage License

1. Read the Family Law Handbook
2. Complete Marriage License Application Form
3. Appear in person at the Clerk’s office to complete the process. Remember to bring a government-issued ID, payment, and, if an approved Premarital Course was taken, proof of completion.

The Martin County Clerk’s Office issues marriage licenses to all qualifying couples. This service is available in the main courthouse and branch offices during regular posted hours.

Requirements:

• Both parties must be present and provide valid identification (valid drivers license, state I.D. card or passport).
• If previously married, the month, day and year that the previous marriage ended must be provided.
• The fee for a marriage license is $86 and may be paid using cash or credit card. When using a credit card a transaction fee of 3.5% will be charged.
• This fee may be reduced to $61 if the parties participate in an approved premarital preparation course provided by a Qualified Course Provider who is registered with this office. A list of these registered qualified course providers is available in the Clerk’s Office. The course provider must furnish the parties with a Certificate of Completion which must be presented to the Clerk’s Office when applying for the marriage license, in order to receive the reduced fee.
• Waiting Period:
  1. Non-Florida residents – no waiting period
  2. Florida residents who participate in premarital preparation course – no waiting period
  3. Florida residents who do not participate in premarital preparation course – 3 day waiting period
• Both parties are required to read the Family Law Handbook (English (PDF) / Spanish (PDF)) prior to applying for a marriage license. Copies of the Handbook are available in our office. Florida law requires you to sign a statement, verifying that you have read the handbook.
• Florida law requires each party to provide the Clerk’s office with their social security number, passport number, alien admission number, or alien file number.
• Blood tests are not required.
• The marriage license is valid for 60 days after issuance.
• The marriage must be solemnized within the State of Florida by an official authorized by chapter 741, Florida Statutes, such as a notary, clerk, ordained clergy, or judicial officer.
• Witnesses are not required.
